This is a hard one for me. I'm assuming we're lawyering the Disk layouts criteria to call this a blocker. I guess as long as we're supporting some BIOS boot configurations this kind of arrangement is perfectly reasonable. At the very least I feel like the installer shouldn't crash.

Yeah crash is an ugly word.
Because we've just implemented the BIOS scope reduction proposal, this is no longer release blocking. Only single empty drives using automatic partitioning block for desktops.
